By accessing or using Is He Playing Tonight's services, including the website isheplayingtonight.com, the Telegram bot @NBA_injury_status_bot, and the Reddit app "NBA Injuries" (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Is He Playing Tonight provides NBA injury status information and notifications. Our Services aggregate publicly available injury report data from the NBA and deliver it through our website, Telegram bot, and Reddit app. We are not affiliated with the NBA, any NBA team, or any player.

3. User Accounts and Subscriptions

3.1 Telegram Subscriptions

To receive notifications via Telegram, you must interact with our bot through the Telegram platform. By subscribing, you authorize us to send you messages about player injury status changes. You may unsubscribe at any time using the /unsubscribe command.

3.2 Push Notifications

Browser push notifications require you to grant permission through your browser. You may revoke this permission at any time through your browser settings.

3.3 Premium Subscriptions

We offer optional premium subscription tiers with additional features. Premium subscriptions are billed through Stripe. By subscribing to a premium tier, you agree to the pricing and billing terms presented at checkout. Subscriptions auto-renew until cancelled. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

4. Reddit App Usage

The Reddit app is available for installation by subreddit moderators. By installing the app, moderators agree to these terms on behalf of their subreddit. The app displays injury information in sidebar widgets and/or automated posts. Usage of the Reddit app is also subject to Reddit's Terms of Service and Developer Terms.

5. Acceptable Use

You agree not to:

• Use our Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the Services
• Scrape, copy, or redistribute our data for commercial purposes without permission
• Use automated systems to access the Services in a manner that exceeds reasonable use
• Impersonate any person or entity
• Use the Services to send spam or unsolicited messages

6. Intellectual Property

The Services, including their design, features, and content (excluding third-party content such as NBA data), are owned by Is He Playing Tonight. NBA team names, player names, and related marks are the property of the NBA and its teams. We use this information under fair use principles for informational purposes.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF INJURY INFORMATION. INJURY STATUSES CAN CHANGE RAPIDLY, AND THERE MAY BE DELAYS IN OUR DATA. YOU SHOULD NOT RELY SOLELY ON OUR SERVICES FOR MAKING DECISIONS, INCLUDING BUT NOT LIMITED TO FANTASY SPORTS OR BETTING DECISIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IS HE PLAYING TONIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
